Spray drift from a neighbouring paddock or a contractor error can put a block into a lengthy decertification period, and the loss is the price premium rather than the produce itself. Standard farm wordings do not usually contemplate that at all.

What is it?

Certified organic operations in Australia are audited against standards administered by bodies such as Australian Certified Organic, NASAA Organic and the Bio-Dynamic Research Institute, with a conversion period before full certification is granted. They run everything from broadacre cereals and beef through to dairy, eggs, vegetables and viticulture, using mechanical and biological controls in place of synthetic inputs.

A neighbour's contractor sprays a boundary paddock on a still warm morning and drift settles across a certified block. The produce may still be saleable, but only at conventional prices, and the real loss is the price premium across the decertification period.

Shared sprayer contaminates a paddock

A contractor arrives with a boom that was not fully decontaminated after a conventional job and treats a certified paddock. The certifier suspends that block, and whether anything responds depends on whether contamination and loss of certification appear anywhere in the wording.

Certified fodder lost to fire

A hay shed fire takes a season of certified organic fodder that was set aside for winter. Replacing it with certified feed costs more than conventional hay, so the valuation basis on the schedule decides how much of that gap is recoverable.

Worth confirming in the wording

  • Worth confirming whether loss of certification, the decertification period and the organic price premium are named anywhere in the wording rather than assumed to follow from a contamination event.
  • Worth confirming whether the liability section responds if produce you sold is later found to be contaminated and a buyer withdraws or recalls it.
  • Worth confirming whether pursuing a neighbouring landholder or contractor for spray drift is something the insurer will handle as a recovery, or a matter you carry yourself.

Common questions

Can I insure against losing organic certification?

It is a specialist question rather than a standard inclusion, and a general farm wording rarely contemplates it. Some arrangements can be discussed with underwriters where the certification, the neighbouring land use and the price premium can all be evidenced, but availability, eligibility and terms vary considerably and nothing should be assumed.

Does my farm policy cover spray drift from a neighbour?

Physical damage to a crop from a defined event and economic loss from decertification are two different things, and most standard farm wordings deal with the first rather than the second. It is generally worth raising the specific exposure with a broker before a season starts rather than after drift has occurred.

Do I need products liability if I sell direct at farmers markets?

Selling direct to the public generally increases rather than reduces the exposure, because there is no intermediary between you and the consumer. Many market operators also require stallholders to hold public and products liability at a stated limit, so the market's own conditions often set the answer.
