Cover for farms that host paying visitors, stays and events.
Opening the farm gate to the public changes the risk profile completely. Paying visitors walk past machinery, climb on hay bales, pat animals, eat food you prepared and drive on tracks built for tractors. Public liability moves from a background item to the main event, and most standard farm packages were never rated for crowds.
Agritourism covers farm stays, cellar doors, u-pick orchards, farm gate shops, lavender and sunflower fields, animal experiences, paddock-to-plate dinners and increasingly farm weddings. Some states, including New South Wales, have loosened planning rules to make it easier for primary producers to host visitors. The common thread is a working farm carrying commercial hospitality, retail or accommodation activity alongside production.
Injury to visitors and illness from food or produce you sell, subject to the policy terms and the activities declared.
Cottages, cabins and glamping structures, plus damage caused by paying guests.
Weddings, open days and dinners, including liquor liability where alcohol is served.
A family walking out to a sunflower paddock trips on a rutted machinery track and breaks a wrist, then claims medical costs and lost income. Public liability generally responds where negligence is established, and insurers typically ask straight away what signage, marked paths and risk assessments were in place.
Twelve guests at a paddock-to-plate lunch fall ill and the local council opens a food safety investigation. Products liability commonly responds to illness caused by food you prepared and sold, subject to the policy terms, and the food handling and temperature records usually become the centre of the claim.
A child feeding a calf in an animal contact yard is knocked over by a larger animal and needs hospital treatment. Animal contact activities are usually rated and worded separately from general farm liability, so the first question asked is whether that activity was ever declared.
Even occasional public access changes the risk an insurer is rating, so it generally needs to be declared rather than treated as an incidental farm activity. Some insurers can add a limited visitor extension to a farm package, while others want a separate hospitality or events policy alongside it. The frequency matters less than the fact that members of the public are on site.
Not usually by default. Weddings bring marquees, catering, alcohol, hire equipment, parking and a large number of people who do not know the property, and most farm packages were never rated for that. It is worth confirming whether functions are included, conditional or available only as a declared extension.
It depends, and two farms with identical land can price very differently based on activities alone. The main drivers are annual visitor numbers, the activities offered, food and alcohol service, animal contact, accommodation type and capacity, the liability limit chosen and the claims history. A broker prices it against the declared activity list rather than the hectares.
Market operators, councils and venue owners commonly require a minimum public liability limit as a condition of a stall or a permit, so the requirement usually comes from the contract rather than from insurance law. Produce you sell also raises a separate products liability question. It is worth checking what certificate of currency the market asks for and confirming your policy covers selling away from the farm.
